Q: If we get married am I going to be liable for an accident caused by my fiancé in 2001? Will they come after me?
My partner had a car accident in 2001 in which he was found partially guilty, although the accident was due to bad weather conditions. About $800,000 damage was caused (hospital fees). He did not and still does not have any assets under his name. If we get married now am I going to be liable for this event? Am I going to risk my assets (house, car) by marrying him? Thanks
A: As long as you do not comingle any assets (meaning have nothing in any joint accounts) then you should be fine. If there is a judgment against him for 800,000, and he has other debts, and no assets, he MIGHT benefit from bankruptcy.
