Miami, FL asked in Probate for California

Q: Can I be added as a petitioner to a california probate case while waiting for docs to prove I am related to the deceden

Does the burden lie on the probate attorney handling the case to prove my relation to the decedent or do I need to prove I am related before being added as a petitioner / interested party? This is a California probate case in Los Angeles.

A: If you are asking whether, as a potential heir, you are entitled to notice of the petition, the petitioning party is responsible for giving notice to all who are legally required to receive it. If you are asking whether you can or should petition yourself, the attorney handling the case is not your attorney; you should retain your own counsel. If you just want to be generally notified about select events in the case, you can file a request for special notice.
