A: Not sure how you can justify tailgating at safety for life. I would not try fighting for that. You can plead not guilty and then see if the prosecutor will plead it down from the five point violation.

A: If it is a justifiable fear that can be proven it would be a winning defense, but to prove it you would need video evidence if you want to have a good chance to win. Either way you should definitely hire a lawyer it is a 5 point ticket that can really kill you on your insurance and give you overnight a bad record. Most of us traffic ticket lawyers offer a free in office consultation, I suggest you set one up.
