Q: I am self employed what happens if I send some of the child support that month but not all ?
A:
Hi and thanks for your question! I understand it's tough, especially around the holidays, to make ends meet. But, one item you don't want to miss paying if at ALL possible is your child support, especially if there is a court order in place for a specific amount of child support that must be paid each week or each month.
If you have had a significant change in circumstances since the child support was put in place, then you may have grounds to reduce the amount that you pay. But, be mindful of the fact that the judge must see a real change in circumstances and not just a temporary situation like a slow down in work. If your business is not bringing in the same income, you may have to get a different job in order to make the support.
Talk to an attorney. Bring with you all your financial documents and any court orders that talk about child support, custody and parenting time. You can at least get more detailed advice and a good game plan if you do have a case to lower your child support amount. Many family attorneys, like our firm offer free consultations. Hoping this was helpful! Regards, Bari
