Q: I got a ticket for 89 in a 65 in Marlboro.
Looks like 4 points. Is it worth getting an attorney in order to fight points or should I just fight myself. My insurance went up $100/mo for a two point speeding ticket back in 2015. What’s the fine potential in front of Judge Newman? Am I at risk of a license suspension? I work in Sales so I need my license.
A: You will not lose your license. Always suggest getting counsel as you have a better chance of getting a reduction in points and fines with one.
A: With judge Newman you always have a chance of losing your license especially without a lawyer and especially if the cop told you that you were going faster but gave you a break to 89 instead of 90 as that is where he suspends licenses. Although Judge Newman is not as tough as he was 20 years ago, he is still one of the toughest judges in NJ. Thus I would disagree with my colleague that said no loss of license and I would say yes, possible suspension of your license for a short period of time even with a lawyer, but much more likely without one. As for points I am sure you can reduce to 2 on your own and if eligible you can take a safe driving course but check that your insurance company will honor it.
A: License loss with an attorney at that speed in front of that Judge would be low percentage but not 0. Without an attorney percentage is higher. The only chance at a 0 pointer in that town is with an attorney. There are various options to choose from, try to reduce and take a safe driving course, eat the 4 points and take such a course. All should be discussed with an attorney. If your company is charging you for 2 points you need to see what they do with 0 point "unsafe driving" . I have heard.but do not know, that charge may be a problem as well.
