Gallatin, TN asked in Personal Injury and Car Accidents for Tennessee

Q: man in AA only had liability insurance. Other man was considered "at fault" by police. At fault ins won't pay.

They say they won't pay because he was in the middle lane and gps says he traveled 300 ft. There were 3 l anes. Right lane went straight only. middle lane had an option of left or right (non stop), and left lane turned left only. There was no traffic light or stop sign. It is a continuously moving lane. The lane just began when an oncoming vehicle hit him head on. From my understanding, 300 ft only applies to a middle turning lane with traffic going both ways, and even if it did apply, 300 ft is within the max amt. of feet that is legal. Can you offer any advice or help. His vehicle was only worth about $4,500.00, but he has no other money and is bearly hanging onto his house right now as it is...ty

A: I am not sure I fully understand this. First of all a GPS is not particular accurate. I am wondering if you are talking about an onboard computer. If the police officer noted the other driver as "at fault" I am wondering what the insurance company is doing or how the insuranc company would have gotten some data about 300 feet from a GPS. Lots more information needed.

A: What matters is where damage is on vehicles, layout etc. If you were hurt, contact a member of the Tenn Assoc for Justice--they give free consults.

If you have collision, run it through that and let your company chase them for that (including your deductible). I f you don't next step is to check facts, and file a complaint with the state insurance commissioner. Do not give statements to the other company. If you did get a copy, but don't be going back over your facts with them.
