Q: Roommate filed false report to law, she hasn't paid rent two months,she trying to get me evicted by landlord

She claimed i/we threaten her on thanksgiving, we tried to communicate to see if she wanted anything to eat she stayed in her room never came out, she been on a depression with meds and smoking weed when i told her not to do that around me cause of my CDL license, so she mad a false report but i had a witness nothing was done or said to her as she claims now shes trying to get me evicted and she owes two months of rent. She has not been here not for a week. What is my rights to towards landlord on staying here? She is very unstable and now trying every trick to stirr up trouble to get me evict so she can get a free month here and the deposit that i paid for, she didnt help but said she would pay back but never did.

A: Who does she owe this rent to? That person likely has a cause of action against her. Beyond that, in the end you cannot control what a roommate alleges about you - to the police; to the landlord; or to anyone else. IF the police or the landlord elect to believe her claims, then you will likely have to deal with defending yourself, perhaps with the assistance of an attorney. For the landlord to evict you, you will have to be served termination of tenancy notice(s), giving you both time to "cure" the problem (assuming you have not received any such prior notices in the last 6 months) and specifics as to the allegations against you. It is unclear whether you are both on the same rental agreement or if you each have separate agreements. If you both are on the same agreement, termination of one of your tenancies likely terminates both of your tenancies so both you and your roommate need to use care in what you do. Questions?
