Q: Can I sue a school that allowed my daughter to be sexually assaulted by another student while the teacher watched.
Back in 2013 my wife recieved a phone call from my daughter's teacher stating something really bad had happen to my daughter. We rushed to the school to meet with the teacher and was told my daughter performed oral sex on another student. Previous to this incident my daughter complained about this student kissed her without her permission. The school was informed about this and the teacher was told to keep the boy away from my daughter. The day of the incident the teacher watched as my four year old daughter and this little boy go behind a shed that was on the playground and the little boy proceeded to pull his pants down and place his penis in my daughter mouth. The school told us that the teacher was terminated and wouldn't be returning and offered counseling for two sessions. The little boy's parents refused. Now my daughter is alittle older I'm starting to see signs that may stem from this incident and to make matters worse I've recently discovered the teacher is back at this schoo
A: If the school is somehow liable, be aware that the statute of limitations may be 4 years.

A: Please contact an attorney soon. You can definitely file a lawsuit for this awful situation, as long as it isn't past the statute of limitations. Please contact a local attorney soon that can advise you how to proceed.
