Smyrna, GA asked in Car Accidents and Traffic Tickets for Georgia

Q: Had first car accident yesterday. My gf was driving, but I got arrested for driving w/ suspended license. What do I do?

With all the confusion of being in my first accident, I was concerned with piecing everything that happened. I was more concerned with my car and my girlfriend. I don't ever even remember telling the officer who was driving. I did tell him that it was my car though. I took charge of the situation when he arrived since it was my car and I guess he assumed I was driving. Also I was the one that called and the other driver was at fault and got a citation. I actually didn't even know my license was suspended until he randomly told me to put my arms behind my back. He said my license was suspended so I thought that was a crime just having a suspended license in my possession. At the time I was just dumbfounded that my license was suspended, but now I find out that owning a suspended license is not a crime. I had to pay $800 to get out of jail and I find out I didn't even break the law. How do I get that money back? What do I do now?

A: Both of you should speak with a member of the Ga. Trial Lawyers Assn--they give free consults. Assuming your girlfriend will say she's driving you can fight the ticket. Plead not guilty.
