Denver, CO asked in Animal / Dog Law for Colorado

Q: Can a lady who was arrested sue me for getting rid of her dog that I could not home? We fostered her children not the do

We fostered her children for 9 months but after a few weeks, we decided we just couldnt keep the dog. Now after she is out of jail, she is saying she is taking me to court for rehoming ( not selling) her dog.

A: She can sue you for conversion, which is essentially the legal term for civil “theft”. Even though you did not technically steal her dog, she can sue you for the value of the dog because you can no longer give her dog back to her. It would be best to discuss this with an animal attorney to go over all your options and likely outcomes.

A: She can possibly take you to court (small claims), but since you don't have the dog anymore, her damages will probably be limited to the replacement cost of her dog. If you get served with a complaint you should contact an experienced animal attorney for a consultation.
