Q: Is a parents failing health a sudden and unexpected change in circumstance when trying to relocate with kids, Florida?
My mother lives in the UK and her health has suddenly started to decline. She now needs assistance with daily living. I want to move to be with her but, with minor children, my ex is blocking our move by using the 50-mile rule. When going to court can I use a parents failing health as a sudden and unexpected change in circumstance? She cannot live in the US as she cannot afford health care. It is FREE where she is now. And up until now, her health has been good but, at 73, it's going downhill now.
A:
Yes. You can but the decision of whether to allow you to move is totally up to the judge.
Good luck.
