Q: My daughter’s father signed his rights over when she was 1 she’s now 6 and my Husband want to adopt her will it be hard

Her biological father Has been paying child support for 6 yrs and I have soul Custody

A: Possibly. Whatever it was that that the bio dad signed is old and if he doesn't want to give up all of his rights now, ypu'll have to proceed with an involuntary termination. Although paying child support over the last 6 years is not performing much of a parental duty, some courts may consider it to be enough to refuse to involuntarily terminate his rights.. I'd recommend asking if he'll sign a voluntary termination agreement now. If he is, you're in good shape. You really should consult with an attorney experienced in adoptions in your county as this can be a complicated process and, frankly, some county courts want you to have an attorney to shepherd the case through the process.
