Q: Can your child's counselor be allowed to be in contact with one of the parents lawyers.

My daughter has been seeing a counselor for emotional stability during her fathers and I's separation. I've found out on social media that he's been in contact with our child's counselor and that counselor has been talking to his lawyer and making comments such as "Dont worry, I've been in contact with (insert lawyers name)". He ordered a summons against me and I feel as though our child's counselor should be unbiased and not be in secret contact with his lawyer. Am I correct in thinking that they shouldn't be in contact especially in the case of her siding against me.

A: An attorney can be in contact with any person who is a potential witness. You are not correct in thinking that the lawyer may not contact the counselor. There are limits to what the counselor can disclose, both in and out of the Courtroom, but there is no prohibition against an attorney contacting the counselor. In fact, the attorney should interview the counselor.
