Q: Do I have to list child born during marriage during divorce if neither parent has custody and both signed over rights?

My ex and I have been seperated for 5 years. We both signed over our parental rights 5 years ago. Now I cant locate spouse to get a uncontested divorce. I want to do a divorce by publication, but am lost as to if I must include child born during the marriage in the divorce, or do I not have to include the child, since neither of us have custody of the child. It's almost like the child is irrevilent to our divorce case. Thanks

A: You should notify the court of the child born during the marriage. If you do not yet have an attorney, get one asap to ensure that the case is done correctly.

A: Yes, but you should also indicate that both of your rights were terminated. Getting a divorce by publication isn't a simple matter. You should really have an attorney or other experienced person help you.
