Q: rear ended a vehicle, he was at a dead stop on the other side of a hill. Couldn't not stop by the time I seen him

Do you think I could fight the careless driving ticket in court?

The 2 people in the other vehicle and a witness said it wasn't my fault. But FHP says I should've had enough time to stop. However, the hill lacked the view to be able to stop in time.

The other vehicle (the one I rear ended) was stooped in the road because a bicyclist was riding on the street, that was when they became at a dead stop. So, they did have a good reason to be at a complete stop. With that detail does fighting it in court give me a chance?

A: Figure the distance from where the car was to where in a car you could see their car. If they had no reason to be stopped --i.e. looking at their map etc--you can win though their insurance will fight it. Convert the distance into car lengths.

I had a case where my client hit a car that had stopped for no good reason in the middle of the road. The cop ticketed the other driver, but the other drivers insurance still fought it. We won eventually on her claim for injuries.

You should plead not guilty and consult a member of the Fla Justice Assn who handles tickets in hat county as well as car crashes--they give free consults.
