Jackson, TN asked in Personal Injury, Traffic Tickets and Car Accidents for Tennessee

Q: Who is responsible?

I let my friend borrow my car. I don't have insurance. I'm not sure about him. And I told him to have it back by a certain time and he didn't have it back by then. So would that be consider stolen? He wrecked the vehicle. Who is responsible for damages? And who will receive the pentaly for no imsurance?

A: The owner has a penalty for no insurance. They will also try to hang the damages from the crash on you, though you shhould try to get him in on that.

A: Let's hope your friend has insurance and that the accident wasn't his fault or bad. Because the vehicle is titled in your name there will be a presumption against you as to a defense. Also, the proof of financial responsibility will be as to you and your friend. Unless you reported the vehicle stolen you likely will have a hard time defending on that basis
