Q: In Florida, my daughter was hit from the rear by another driver. Small fender bender without any injuries.

We contacted our insurance company and sent pics they closed the claim and will not payout since her car only liability insurance. The other driver is now claiming my daughter swerved into her and her insurance company claim is still pending Photos of our cars damage. We seem to be getting the run around as the insurance company keeps telling us to upload photos to a particular link they email us however they never get the photos. We have requested to send them photos via a different means but they say the upload to their particular link is all they will accept. It's been almost a month do we need a lawyer?

A: Assuming your daughter was hurt, contact a member of the Fla Justice Assn--they give free consultations. If she absolutely positively wasn't hurt, get the police report (not the short copy she got) send that with pictures (you can send them hard copy of printouts or actual prints). I assume you have estimates. If they don't pay then file a complaint with the Insurance Department as they have 30 days to provide fair and reasonable settlement.

Do not let them give you a check for "all claims"--should be "for property damage only"
