Minneapolis, MN asked in Domestic Violence and Criminal Law for Minnesota

Q: My hsbnd thrtnd to rape me multi x 1 night and tried to brk thru the door. I moved out 30 days ltr. Is it 2 late 2 file?

A little more info: One day in late Sep 2017 my husband was very angry. He tried to break through the bedroom door that I locked and hid behind with my small dog. He threatened to rape me repeatedly, telling me that it was going to hurt. I was too afraid to call 911, but told him that I would call if he didn't stop. He asked what I had said (he was yelling over me) and I repeated it. He then stopped immediately and went to another part of the house. The handle on the door was very damaged. I thought he had locked me in. I had to pry the handle to get it to open the door. I was shaking by this time...terrified. That night I applied for a new place to live. It's the first time he threatened me like that. He's often done the veiled threats and thrown things at me, has even pushed me and put holes in the walls. I didn't leave because I was ashamed of another incident, but I was very afraid. My address is protected by the Safe At Home Program. Is it too late to file a police report?

A: It is not necessarily too late to file a police report. The offense you are describing is called a Terroristic Threats. The question is whether a prosecutor's office would charge out the offense five months later. That is an entirely different proposition.
