Richmond, VA asked in Child Custody for Virginia

Q: According to the Commonwealth Attorney of Va. They do not get involved with custody issues. I explained that baby mother

fled the State of Va. without having given the father (who has joint legal custody only and was never married to baby mother) 30 days written notice. She states that she and the children (2 others by different fathers and our grand-daughter ) were in danger by her boyfriend. However she withdrew the children 3 days prior to fleeing the state of Va. She has apparently moved to Texas. I have tried filing charges through the magistrate also with no success. I keep being told that Juvenile and Domestic court is only way but they will not allow me to file criminal charges. So what can I do?

A: You have been given [mostly] accurrate information. The JDR Court is the appropriate place to go. Given the severity of the situation, you should hire a lawyer to file the appropriate paperwork forcing the mother to bring the children back to Virginia.
