Chicago, IL asked in Criminal Law and Federal Crimes for Illinois

Q: Can the father of my baby be taken away during the birth or go to jail if I'm a minor?

I live in Illinois, and I am 39 weeks pregnant. I am 14 years old and the father of the baby is 18 years old. We have agreed that he will be there during the birth, and will also sign the birth certificate. Do you think the hospital or somebody will turn him in? Do you think he'll get locked up? I really do not want my child to have a dad in jail.My parents don't know his age, but suspect him being older. It's unlikely they will press charges if they found out. Does the father still have a right to be there during labor and birth, or is there a chance he can get taken away?

A: Can he be arrested and taken away during labor/birth? Yes. Is it likely to happen right at that time? No, although it will likely happen at some point. In the eyes of the law he committed statutory rape and is a sex offender if convicted.

A: Yes, the hosp is mandated to turn him in, it is child abuse. But if u or ur parents do not push it, it is unlikely that anything will come of it.
