Knoxville, TN asked in Juvenile Law and Criminal Law for Tennessee

Q: What are the charges for a 22 year old having sexual relations with a 16 year old?

Are there different charges for intercourse as opposed to other actions, and if so what are the differences?

What age (compared to 22) does the class of the felony increase?

A: I am not sure what other actions you mean. Mitigated statutory rape applies to an adult engaging in "sexual penetration" of a minor who is at least 4, but no more than 5 years younger than the adult and is at least 15. Aggravated statutory rape is sexual penetration by an adult who is at least 10 years older and the minor is at least 13. Statutory rape is where the child is at least 13 and the adult is between 4 and 10 years older.

Statutory rape and mitigated statutory rape are both Class E felonies (1-6 years). Aggravated statutory rape is a Class D felony (2-12 years). There is also the possibility of having to register as a sex offender.
