Aurora, CO asked in Car Accidents and Personal Injury for Colorado

Q: If I have to drive my personal car for a work purpose and I get in an accident is my employer liable for the damages?

I was told by my employer to drive my car to pick up an item from another office due to a wrong item delivered to mine. On my way to pick up the item, I hit a patch of black ice and slid into another car. My work is saying they are not liable for the damage since they don't carry insurance on me. I'm thinking since it was their fault for not bringing the correct product to start with and then telling me to go to another office to pick up the correct product, they should be liable for any damages not me and my insurance.

A: They are correct, though morally as you were using your car they should at least pay for the deductible. If you were hurt it is a workers compensation injury.
