A: You need a court order which defines your custody rights. The 3-year-old may be your legal child, even if not your biological child. You should retain an attorney to help you do this.

A: You have rights regarding both children. You need to assert those rights by filing a custody (allocation of parental responsibilities) case. She does not get to just control the situation, but you have to assert yourself to change things. You should consider consulting with and hiring a child custody attorney to help you with your case.
