Q: My landlord gave me a 90 day notice listed as a nonlease renewal up 1/31/2018. Do I qualify for relocation assistance?
I asked if she had to pay me the relocation fee and she told me that they only had to do that if it was a mass eviction. She told me a year ago that they wanted to remodel my unit, and did not provide me with another unit, so I'm being forced to move next week. I have been a tenet in this apartment since 10/3/2013 and my last lease was for a year.
A: The answer depends upon the exact wording of your expiring lease, the landlord's notice of non-renewal, and the landlord's circumstances (whether the landlord is exempt from paying the relocation assistance even if they otherwise would be obligated to). To the extent that she is supposed to, you may already have claims regarding her timeliness, again depending upon the exact details. So you may wish to gather the documents and take them to a local landlord-tenant attorney for analysis and review. If it appears that you do have claims against her, it is the sort of a case that an attorney might well take on contingency wherein you don't pay their fees but rather they collect them from the landlord upon winning or settling. If you somehow lose, the attorney goes unpaid. She also will have 31 days from when you move out and restore possession to the landlord to send you a full refund of your security deposit or a written accounting for how much she is keeping and why. So be sure she has a forwarding address to send it to you. You may want to wait on seeing the attorney until after the 31 days are up in case she does not send it to you in a timely manner or in case she overcharges you. If that happens, it too provides you grounds for suing her for damages, including your attorney's fees. Good luck.
