Q: WC stopped sending checks & Job never placed back to work. Recently got IME, & diagnosed with 6 painstaking conditions.
My job has not brought me back, they have been waiting for somewhere to place me since November. Being that was 3 months ago, I have been living off of my savings and ultimately struggling to make it while living in pain. I am having a hard time finding work due to the pain. And the stress of not having any financial assistance is causing me depression. Though I am still employed by my job, I had to recently file for unemployment which I am going through the process right now. WC never sent me to the proper doctor for my back and neck pain, and now 3 months after they stopped sending my checks, it’s apparent that they never should have stopped sending them at all. It’s over 7500 dollars in loss. Shockingly after my injury they sent me to a doctor that ultimately claimed symptom magnification, but they not send me to a doctor for my condition.What are my options in regards to receiving backpay from either the WC or unemployment or is it just loss? Does payment commence?

A: There are many ways WC can suspend weekly checks. The law does require that they meet certain requirements before doing so...however, in any particular situation you have to know your rights and responsibilities under the law so you will likely need to retain a lawyer to get the checks turned back on or help find you some other acceptable result.
