Q: I have not filled out papers for custody for my son but my ex boyfriend took my son and refuses

to let me see him or talk to him I think he's going to take him to Mexico what can I do

A: Contact the police and see if you can obtain their help to get your son back now. You should have your son's birth certificate. If no court orders exist, you are the custodial parent and have the right to have your son in your care. I also recommend seeking the help of a family law lawyer immediately to file an appropriate court proceeding to protect your son.

A: I would start by obtaining a copy of the birth certificate and asking the sheriff or the police to assist you with having your son returned to you from the Father.

I can only give you information regarding Arizona law, but I suggest you begin a Legal Decision-Making (Custody), Parenting Time and Child Support case in the Superior Court.

If you serve him with that paperwork, he will also be under court order not to remove your child from the State.

If you don't start there, I would file a Petition for an Order of Protection against the Father and include your child, if he has threatened to take him.
