Q: Can I be sued for breech of contract if I'm not the owner?

I recently parted from a tax preparation franchise. There is a 2 year no compete clause in my contract. A family member opened a tax prep company. I made a post on my private personal facebook page promoting it. Another owner took a screenshot & submitted it to corporate. Now I received a letter stating I have 7 days to cease operation. It's not my business to cease. I will no longer promote this business but is there anuthing they can do legally? I'd hate for my post to affect my family member's business.

A: An attorney would need to review the franchise contract that contains the non-compete clause to answer this question. Most non-compete clauses do not cover extended family members. Although, it is possible it covers promoting other similar businesses.
