Q: How can I ensure that my landlord knows about the portland relocation assistance ordinance?
I live in a 2 bedroom unit and I believe she needs to pay me $4200. She served me a 90-day notice on 1/29/18, and from what I have researched she has until 3/15/18 to pay that. I do not want to add fuel to the fire, so to speak.
A: Why would you want to? It is the landlord's duty and obligation to know and comply or be subject to the consequences. IF they do not pay you (AND are obligated to - i.e. the landlord is not exempt from having to pay the relocation assistance) at least 45 days prior to the termination date in their notice, you are entitled to not only recover the relocation funds but also up to 3 months rent plus any actual damages plus your court costs and your attorney's fees. So staying quiet may get you at least 3 months rent if they do not comply. Further, these are the sorts of cases that landlord-tenant attorneys are likely to take on a contingency meaning you would not owe them anything for their time (beyond the initial interview/evaluation) but rather they would rely upon collecting their fees from the landlord upon winning. If, somehow, you did not win, the attorney simply goes unpaid. And yes, $4200 is the correct amount for a 2 bedroom rental dwelling.
