Q: Can I file a D.O.R. since the insurance company neglected to provide me with a notice as to why my shoulder was denied?

My CA workers comp case closed in 2014. I had a neck and shoulder injury. The shoulder injury was not included for future medical even though the QME'S notes stated that I should have future medical for it. As of 2017 my Employer has gotten a new insurance and my files have been transferred to a new insurance company and I was told today by this insurance that I should have had received a notice stating why the shoulder was denied for future medical. Is that true? For that reason can I file a D.O.R? I did receive the paperwork from the Information and Assistance Office and he didn't indicate that it was too late to file. Thank you in advance.

A: You need to speak to a Workers Comp Attorney to discuss and review your case. More info is needed. If you are still employed, then you need to file a CT claim and address all body parts that are injured and or getting worse while you have been employed at the same employer. If you are not employed with the same company, you still need to speak to a Workers Comp Attorney.
