A: It’s difficult to say whether he will get the increase in visitation and decrease in support without more details. Both changes involve consideration of a many details. It is possible what he requested will be granted depending on the details, but without more information it’s hard to give you any advice here. Please consider consulting with a family law attorney about this. You can discuss the details in full and the attorney can give you advice on what to expect and what may happen and can represent your position in court.

A: Thank you for your question. I am more than happy to assist you.

Typically if your child’s father has parenting time, he is privileged to know where your child is living. In order to modify the parenting time schedule, he has the burden of proving that there has been a change in circumstances that would warrant a change. The court must apply several factors to determine the best interests of the child while weighing the rights of both parents as well as the right of your child to continuing and frequent contact with both parents. It is important to protect your interests and have an experienced family law lawyer advocate for your interests. I strongly suggest that you meet with an experienced family law attorney who can access your matter.
