Lowell, MA asked in Personal Injury and Products Liability for Massachusetts

Q: I was injured at Bj's wholesale Club by a broken carriage.

I grabbed the front of the carriage and not realizing it the rusty metal pierced my skin about an 1/8 of an inch. The metal splinter went through my ring finger, I was bleeding. I called for help and the manager on call got a splinter kit. Unfotuantly, the splint needle was too thick and the manager wasnt able to get the splinter out. In panic the the manager gave me a thumb unsanitized thumb tack to remove the splinter. It only removed some fragments. We put a bandaid to stop the bleeding but I had to do home to remove the rest. I felt that Bj's neglected to inspect there carriages. I dont understand why they would have had that carriage in use in the first place. Its unexceptable. I did go to my doctors to get a tetnanus shot just in case. The carriage was rusty. Can I file negligence on Bj's Wholesale Club?

A: Yes, but your damages are what they are not what could have happened. If you still have problems you need to return to a doctor.
