Q: Can you be charged with destroying evidence if the cell phone is in your name but your father had it?

I knew the cops were with my dad but they didn't tell me he was being arrested yet. The phone he had was in my name and had my personal info and things. They are saying because I deleted everything from the phone I destroyed evidence. When he called me from jail I realized the severity of the situation but was recorded saying I am sure it hurt their case but it's my phone. I didn't know it was being used for anything illegal and they failed to tell me they were using it as evidence until after the fact.
