Laredo, TX asked in Traffic Tickets for Texas

Q: I got a ticket with 2 citations: 1 disregard RR crossing 2 stopped within 15ft of RR crossing Now, this is the reason

I was behind a semi truck in a red stoplight, goes green we start moving and a constable turns strobes to stop the truck front of me so I yield leaving on top of RR tracks. Now light goes yellow and the semi doesnt move because apparently theres more traffic, I cant go back ‘cus I have trucks behind me. By then im stopped in a red light, theres traffic on the crossing street. A sheriff points at me to move to the side of the crossing street. Now, I stopped in the tracks cus theres a truck with a constable not moving in front of me, in a red light with trucks behind. Theres at least 3-4 police/constable patrol car inthe crossing. They left me there, and they just want me to pay the violations. I requested to talk to the judge, what can I do or what should I expect in the hearing.

This was all their fault, they left me in that spot.

Pleade help.

A: In general, traffic cases are strict liability; you either did or didn't commit the offense, and if you committed the offense, the reason why will go to punishment, not guilt or innocence. For example, "I didn't know I was speeding, my speedometer was broken", is not a defense. That being said, you have the right to contest this matter and force the State to prove any allegations beyond a reasonable doubt. Set the matter for trial (calling a local attorney will help)
