Q: Hi. I am on F1 visa now and have been in US for 4 years. I want to apply for an asylum. What are my chances?

I have a fear of returning back to my country. And want to apply for an asylum. How high are my chances? And I will be graduating this year and if I apply for an asylum and have a pending case, will I be able to get OPT? Thanks in advance.

Edit: I have a fear of returning based on my faith. My faith is persecuted in my country. The reason I haven’t applied earlier, I waited to see if situation changes and also I wasn’t sure If I qualify for an asylum. But recently I learned that I might qualify, and situation in my country hasn’t changed but only got worse.

A: That is hard to say without knowing the details of your case and why you fear returning.

Also, an asylum application is supposed to be filed within a year of arrival in the US in most cases.

An asylum application should not affect your chance of getting OPT.
