Q: Do I have to pay rent during eviction?

My landlord will not fix ANYTHING in the house, it has Mold and flood damaged, heater is also condemned, she never had anything inspected before we moved in 2014, I have 4 kids in this house. and now we are being evicted for the 3rd time, after the house has been in many foreclosure..

A: In principle, a tenant owes rent for every day they are in possession of the dwelling, assuming their tenancy has been otherwise properly terminated. However, you may be entitled to a reduction in rent for the habitability violations and/or other possible violations of the landlord-tenant laws by the landlord. The cumulative amount of said reductions might entitle you to a net refund or as an off-set to any rent otherwise owed. All in all, you should simply review it all in detail with a local landlord-tenant attorney.
