Denver, CO asked in Animal / Dog Law for Colorado

Q: Can I get in trouble even if my husband is the one being cited to court?

My husband has a dog and the other day I was walking him, im 6 months pregnant and we were on top of this little hill in our apartment complex, i almost fell and lost control of my dog and he ran up to a man and his dog, nothing happened he didn't do anything but being a bigger dog the man got really upset and filed a complaint with animal control. Today we had an officer at our doorstep serving my husband papers i guess because he's the legal owner of the animal, he now has a court date for failing to restrain the dog and the man exaggerated and said he tried to attack them. My name aint even on those papers but if I go to court with him am I going to get in trouble for that?

A: The animal control officer could have cited you instead because you were the one in control of the dog when he got loose. But since they didn't, they can't cite two people. You're probably the only person who can testify as to your side of the story so you'll probably need to go to court at some point.
