Fort Myers, FL asked in Real Estate Law and Construction Law for Florida

Q: What is the best way to fight errors made by a builder on an option contact after the contact has been signed?

After my initial appointment to select options or upgrades for our home I made another visit a month later to make changes to bathroom tile selections. The person at the designer office helping me failed to change the color and tile size of the tile during that visit for our master bathroom to square. The tile is now in but rectangular, straight horizontal, the builder put it in incorrectly vertical -straight horizontal ( even according to the option contract straight- horizontal with rectangular tile, which is not what I wanted) . What is the best way to handle this matter with the company building the home?

A: There is likely not an easy way. Hopely the builder will Work with you to make it right.

If not you need to consult with a construction lawyer in your area to review your contract and help to negotiate a resolution of this issue.

Good luck.
