Du Quoin, IL asked in Adoption and Family Law for Illinois

Q: What would it take to have a general consent of adoption reversed? The adoption has not gone thru, he is in foster care.

I signed a general adoption for my son while I was in prison under the impression that he was going to a family member. Children and family services removed him from her home a few days after i was released for reasons that were unfounded and they have not placed him back. They have him with a foster family that is trying to adopt him. I would like to have my rights reinstated, especially considering the circumstances have changed. I am clean, sober and no longer incarcerated. I have not been allowed to see him, talk to him or have any contact, which before was not the case. This new family has had him for 4 months and I signed the consent a year and a half ago. My witness was another inmate and I was in a very intensive drug program so my emotions were high during this whole thing. I was told something different than what is happening and now it looks as tho he will be taken completely out of my life. What is my best route to take. I know it is difficult but I love my son.

A: A consent must be signed in the presence of a caseworker or a judge. If that did not happen, the consent is invalid.
