Las Vegas, NV asked in Legal Malpractice and Traffic Tickets for California

Q: Was pulled over, officer questioned my passenger during the stop. I was stopped for a "headlight being out was it legal?

i was driving speed the speed limit (50 mph) and after inspection 10 minutes after the stop the headlight in question was in fact working fine. I am 16 years of age and so was my passenger, which I know is illegal, but I am wondering if it was lawful for the officer to have questioned my passenger to reveal his age.

A: If you or your friend answered questions, you waived whatever rights you might have had to refuse to disclose the information. Plus, you have to identify yourself to law enforcement. ID's contain birthdates. He was going to find out one way or another.

A: need a lot more info

a light out is probable cause for a stop.......

cops manufacture PC......tires low, over the line....once they stop you they can ask questions to be sure a law has not been broken......but you probably did not have to answer and by doing so arguably waived your right to remain silent..........

why were u at 16 driving a passenger and what time of day or night and were you in a bad area?
