Q: if roadwork is being done on a major street (Route 66) at night, law officers are on site for safety, and construction
crew did not place safety cones to narrow street to one lane to code, then after a cone was hit and vehicle stopped. then officers came out of the dark from down the road could this be entrapment for a .09 dui?

i do not think it would be entrapment but certainly there is an argument they did not comply with local rules.........however this would probably not be a defense to the DUI charge..........but more info would be needed.
