Q: Can a bagged salad company be responsible for medical bills related to food contamination?
I made a bagged salad kit after work and ate about half of it when I chewed something mushy and spit out what was clearly a slug. I know people eat snails but slugs are different so I freaked out. After I threw up from being disgusted I had so many questions. Do they carry salmonella, what kind of slugs are common where the product grows, could I get sick, could it have been dead and in that package for a long period of time? I contacted the company’s customer service line for answers the representative didn’t have any answers but took my information for someone to call me back. No one called back. I found them on Facebook my concerns were viewed but I still received no answers. I looked it up on line and immediately found stories of a boy being paralyzed after eating a slug and other stories of meningitis and parasites. I just moved to Florida and transferred jobs and had to go from full time to part time loosing my benefits, if I end up having any medical issues are they be responsi
A:
Every product liability claim like this requires evidence/proof.
If you can prove (a) your food was contaminated, and (b) your illness or injury was caused by the contaminated food product, then (c) you may pursue a claim for damages (financial compensation).
If no actual harm results, then you would probably receive a refund for the purchase. Depending on the circumstances, you may be offered a small sum for your unpleasant experience.

I agree with attorney Harris' analysis and response. The key is proof. I suggest that you consult with a personal injury attorney in your area to get a thorough evaluation.
Good luck and sorry for your situation.
