Q: Can a parent violate court order over accusations without proof?

A: Court orders are enforced through the contempt powers of the court. If a parent violates a court order you can file a motion called a Rule to Show Cause asking the court to hold the parent in contempt of court and thereby compel the parent to comply with the court's order. The court can find a parent in contempt of court if the parent has willfully violated the court order. The court's contempt powers allow the court to do any one or combination of the following as a way to compel compliance: fine the parent up to $1,500, make him/her pay the other parent's attorney fees, jail the parent for up to one year.
