Q: My child's father owns his own business how does he show how much he makes with out hiding the real amount
He has no bank account it is simply the business account but he uses it for both business and self. He says he will hide the truth about what he makes because he does not want to pay any support
A: Lawyers know how to conduct discovery to get at this information. One way is to subpoena all his bank and credit card records, and force him to produce all his payments and invoices for monthly expenditures (rent, mortgage, utilities, cell phone, gas, car payments, auto insurance, etc.). If he pays all that every month, then you know he makes at least that much every month. A court can also make a determination to attribute a minimum amount of income to him in order to base an award, if he refuses to cooperate and voluntarily disclose his income.
