Fort Worth, TX asked in Criminal Law for Texas

Q: Is prison time likely for second family violence case including probation violation?

Someone was arrested for assault family violence impeding breath, had no prior criminal record. She plead guilty to the 2nd degree felony and received 3 years deferred adjudication probation. One month later she was arrested for aggravated assault with a deadly weapon (another family violence situation against the same person). There was no injury but they have her on video acting very erratically and pointing a large knife within inches of someone’s face. Currently having a public defender what kind of time is she facing?

A: This forum can only respond with general legal answers. There is no way to know what will occur in a specific case, because we do not know the evidence in the State's possession. Talk with the attorney who is representing the defendant, but again in general, a person on felony probation who receives a new felony charge for virtually the same offense against the same victim has SERIOUS legal problems
