Q: My daughter is over 18 & her father still owes over $40k in child support. How can I collect if the state isn't?

He hasn't filed his taxes since 2001 (when I received his returns for back support) & the State of MD have always been hard to work with in regards to giving work information for collection. Can I sue the state? What can I do to collect this money?

A: The State periodically applies to the court to have the arrearages reduced to judgment. Judgments last 12 years, and can be renewed an additional 12 years if done so before the expiration of the initial 12 year period. You should review the case history to determine the last time there was a judgment entered to confirm it is up to date through the last support payment due date. The state will continue to attempt to collect for you, or you can try to act by locating him and any assets he may have, or if you know where he works, you can have a wage garnishment imposed.
