Q: I got my first ticket because i didnt stop at the stop sign.i have to appear at the court.can i avoid from get point?

He marked C/i disregard stop sign and marked waring for no proof of insurance but actually i had it on my car.

A: Take your ticket to court and ask that the ticket be set for a "Formal Hearing". The court will set a date and send you notice.

If you have your insurance declaration page showing that you had insurance on that vehicle on the date that you were pulled over, present that proof to the clerk of the court where the ticket was filed. They should dismiss the case. They may charge you $25.00 costs.

MCL 257.328(3) states:

If, before the appearance date on a citation issued under subsection (1), the defendant submits proof to the court that the motor vehicle had insurance meeting the requirements of sections 3101 and 3102 of the insurance code of 1956, 1956 PA 218, MCL 500.3101 and 500.3102, at the time the violation of subsection (1) occurred, all of the following apply:

(a) The court shall not assess a fine or costs.

(b) The court shall not forward an abstract of the court record to the secretary of state.

(c) The court may assess a fee of not more than $25.00, which shall be paid to the court funding unit.

I recommend that you hire an attorney to go with you to your formal hearing. An attorney will probably have a working relationship with the City Attorney, and if you have a clean driving record, should be able to negotiate and get the speeding ticket dropped and may be able to help you avoid any points on your record. Its worth the attorney fee.
