Q: How to properly file an immediate/expedited motion for pre decree temporary orders?
During a status conference it was ordered that the child not relocate at all from Flagstaff, neither to Tucson with the mother or Alaska with the father. The mothers relocation is currently being considered in trial. It is becoming clear that neither the father nor mother (who has primary custody) is able to reasonably accommodate residence in Flagstaff and neither party has the financial means to uphold the court order, however the relevant time frame is within the mothers parenting time. What is the appropriate avenue to have an emergency change in the order? Rule 47 mentions for pre decree temporary orders in regards statute 25-408, but how is this done on an immediate as possible timeline, without the severity of an emergency hearing on custody?
