Q: I Was Hurt At Work In July 2016 I Had A Disc Herniation Had A Discectomy In May 2017 Surgery Didn't Work.

Requested Another MRI & EMG MRI Showed Same Disc Was Herniated EMG Showed Nerve Damage Now Dr Says I Need Another Surgery Do I Have To Get Another Surgery & Dr Says I Can No Longer Return To My Old Job Does This Make My Case Worth More Money?

A: NOT FAIR but NO, losing your job gets you almost nothing!! write your state senator and state assemblywoman that this law beats down their voters and must change immediately, or you will actively campaign for their opponent, no matter his positions. the 'loss' that gets you more money is getting the doctor to write you have a great deal of Whole Person Impairment. Whole Person Impairment comes from being unable to perform 'activities of daily living'. 'Nerve damage' equals ZERO. No Job = Zero. Need another surgery = a little, only if you cash out all future medical rights. A GOOD ATTORNEY WOULD COACH YOU on what to say to the QME and the Treating Physician to get reporting that specifies all of the 'Activities of Daily Living' you no longer complete due to this injury. Just telling the doc you are in pain is worth nothing now.
