Braselton, GA asked in Family Law and Juvenile Law for Georgia

Q: My son's father never paid me anything the first 7yr i had him. Now u owe for 8yrs, can I countersue him?

My rights were terminated long before they found his father to get him to take our son. He was in Foster care when my rights were terminated. My son's father has had him for 8 years and somehow got child support ordered and visitation ordered AFTER my rights were terminated. I don't see how I should have to pay since my rights were terminated and shouldn't I be able to countersue him for all 7 years o had custody and he didn't pay Me? I got my son in November of 2017 cause he couldn't handle him. He started abusing my daughter in my home. I called DFCS and DFCS said I have no rights to him and made me send him back to his father. His father then started demanding that I pay child support. He never worried about the child support until I ended up having to send our son back home. Just because he did not want him back and he was mad is why. Will I have to pay since my rights were terminated? In my question above it is supose to say now I OWE for 8 years.

A: Termination of parental rights does not terminate your obligation to pay support. You cannot sue for child support at this point because you have no rights to the child.
