Q: How do licensing bodies weigh juvenile adjudications in licensing decisions?
I am applying for state licensure as a massage therapist. I went through State Police fingerprinting procedure for a personal record request, the same background check procedure I am pretty sure they use for potential licensees just to see what would come up. Unfortunately, I got a hit on a charge that was adjudicated and several others that were dismissed from a single incident in 2003. I NEVER disclosed these charges to any potential employer and to my knowledge was never denied employment on the basis of them because I thought these records were SEALED from public inquiry. My question is, do juvenile crimes show up in state background checks for state licensing bodies? And if so, do they weigh these charges, dismissed or convicted, in pending licensing decisions? Also, what specifically are the exceptions that allow for public disclosure of juvenile crimes in NJ?
